These Terms & Conditions (“Terms”) govern membership in and use of the services provided by Mindful Stewards Trading Club L.L.C. (“Mindful Stewards,” “the Club,” “we,” “us,” or “our”).
By enrolling in Mindful Stewards, maintaining an active membership, accessing member materials, or receiving trading alerts, you agree to these Terms.
Mindful Stewards is a membership-based trading club that provides members with access to algorithm-generated trading alerts, educational information, member resources, and related services.
Mindful Stewards is not a brokerage firm, investment adviser, financial adviser, or portfolio manager. Membership does not create an advisory, fiduciary, brokerage, or investment-management relationship between Mindful Stewards and any member.
Each member remains solely responsible for their own brokerage account, trading decisions, position sizing, order execution, risk management, and financial decisions.
Mindful Stewards membership is currently $39 per month.
Membership automatically renews each month using the payment method on file unless canceled before the next renewal.
By enrolling, you authorize the applicable payment processor to charge the recurring membership fee to your payment method on each renewal date until the membership is canceled.
Pricing may change in the future. Members will be provided reasonable notice of any change affecting their recurring membership fee before the new price takes effect.
Members may cancel their membership at any time through the membership-management process provided by Mindful Stewards.
Cancellation takes effect at the end of the current paid billing period. Members will continue to have membership access and remain eligible to receive trading alerts through the end of that paid period.
After the paid period ends, membership becomes inactive and trading alerts will stop.
Canceling a membership prevents future renewal charges. It does not ordinarily result in an immediate termination of the current paid membership period.
Membership fees are non-refundable once charged, except where required by applicable law.
Mindful Stewards does not provide prorated refunds for unused portions of a billing period.
Canceling a membership prevents future renewal charges but does not generate a refund or prorated refund for the current paid billing period. Membership benefits and trading-alert eligibility continue through the end of that period.
Trading and investing involve substantial financial risk, including the possible loss of some or all capital committed to a trade.
Mindful Stewards does not guarantee that any trade will be profitable, that losses will be avoided, or that any particular level of performance will be achieved.
Trading alerts report positions or signals generated through the Mindful Stewards trading system and Club process. They are provided as part of the membership experience and should not be interpreted as personalized financial or investment advice.
Members determine independently whether, when, and how to participate in any trade.
Past performance, historical results, simulated results, and prior trading outcomes do not guarantee future performance.
Any examples, guidelines, illustrations, or educational materials concerning position sizing, stop levels, portfolio allocation, or risk are provided to explain how the Mindful Stewards trading system is structured.
They are not individualized recommendations.
Each member is responsible for determining what level of participation, if any, is appropriate for their own financial circumstances, risk tolerance, objectives, and brokerage account.
Mindful Stewards currently uses electronic communications, including email, to deliver trading alerts.
Electronic communications depend on third-party technology and infrastructure. Alerts may occasionally be delayed, interrupted, filtered, routed to spam or promotional folders, or fail to reach a member.
Mindful Stewards does not guarantee instantaneous, uninterrupted, or error-free delivery of trading alerts.
Members are responsible for maintaining accurate contact information, monitoring the email account associated with their membership, maintaining appropriate email and device settings, and taking reasonable steps to ensure that Mindful Stewards communications can be received.
A delay or failure in electronic delivery does not guarantee reimbursement for trading losses, missed opportunities, or other financial outcomes.
Members may be provided the ability to turn trading alert emails off without canceling their membership.
Turning trading alert emails off:
does not cancel the membership;
does not generate a refund;
does not stop recurring membership billing; and
means the member will not receive ENTER or EXIT trading-alert emails while alerts are disabled.
Trading alert emails may be turned back on using the preference-management process provided by Mindful Stewards.
Membership is intended for the individual member associated with the account.
Trading alerts, member-only materials, and other non-public membership content may not be systematically redistributed, republished, resold, shared with non-members, or used to provide substantially similar services to other persons or organizations without written permission from Mindful Stewards.
Members may not share account credentials or otherwise provide non-members with access to member-only services.
Mindful Stewards reserves the right to suspend or terminate access where it reasonably determines that membership credentials, trading alerts, or member-only materials are being improperly distributed or shared.
Members are responsible for maintaining the security of their account credentials and for activity conducted through their accounts.
Members should promptly contact Mindful Stewards if they believe their account, email, or trading-alert preference links have been compromised.
Mindful Stewards may invalidate existing access or preference links and issue new ones when reasonably necessary to protect account security.
Mindful Stewards does not hold, custody, or control member brokerage funds or securities.
Members maintain their own brokerage accounts with brokerage providers of their choosing and are responsible for understanding and complying with the terms, fees, trading rules, order types, margin requirements, and other conditions imposed by their brokerage provider.
Mindful Stewards is not responsible for brokerage outages, execution differences, slippage, rejected orders, account restrictions, or other circumstances arising from a member’s brokerage provider.
Mindful Stewards relies on software, market-data providers, cloud infrastructure, email providers, payment processors, authentication providers, internet connectivity, and other third-party systems.
Although reasonable efforts are made to maintain reliable operations, no technology system is continuously available or error-free.
Mindful Stewards may temporarily suspend or modify services when reasonably necessary for maintenance, security, system integrity, legal compliance, or operational reasons.
Members agree not to misuse Mindful Stewards systems, interfere with their operation, attempt unauthorized access, circumvent security measures, misuse member-only information, or use Mindful Stewards services for unlawful purposes.
Personal information is handled in accordance with the Mindful Stewards Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference.
Mindful Stewards may modify its services, membership features, operational processes, or these Terms from time to time.
When a material change affects an active membership, Mindful Stewards will provide reasonable notice when appropriate or required by law.
Continued use of the membership after an updated Terms effective date constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Mindful Stewards may suspend or terminate membership for material violations of these Terms, misuse of Club systems or materials, fraudulent activity, nonpayment, security concerns, or other circumstances reasonably requiring suspension or termination.
Where appropriate, Mindful Stewards may provide notice and an opportunity to address the issue before termination.
To the fullest extent permitted by applicable law, Mindful Stewards is not responsible for losses resulting from individual trading decisions, market movements, brokerage execution, delayed or failed communications, third-party service interruptions, or circumstances outside Mindful Stewards’ reasonable control.
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited.
